What to Do If You Lost Your Land Title in the Philippines

The good news is that Republic Act 26 and Presidential Decree 1529 allow for the judicial reconstitution of lost or destroyed Torrens titles. The process involves filing a petition before the RTC of the province or city where the property is located.

To file for reconstitution, you will need: a Certified True Copy of the title from the Registry of Deeds (if available), tax declarations, tax receipts, deed of sale or other documents proving ownership, survey plans, and any other documents that identify the property and its owner.

The judicial reconstitution process typically takes 3 to 12 months, depending on the complexity of the case and court backlog. After the court issues a decision, the Registry of Deeds cancels the old entry and issues a new title in the owner’s name.
